California Significantly Expands Privacy Breach Notification Law

California Governor Jerry Brown recently signed into law an amendment to California’s landmark data security breach notification law (Senate Bill No. 1386), first enacted in 2003. The original law, S.B. 1386, requires companies doing business with California residents to provide notice to the residents of any actual or suspected security breach involving unencrypted personal information or data of the residents that had been collected and maintained by the company.

President Obama Signs Patent Reform Bill

On September 16, 2011, President Obama signed H.R. 1249, the “Leahy-Smith America Invents Act” (AIA). The AIA was passed by the U.S. Senate on September 8, 2011, without any further amendments to the House version of the law. This “patent reform” bill will put into effect several profound changes in U.S. patent laws during the next year. The changes will occur both in the front-end stage of filing and prosecuting patents, as well as the post-grant stage after patents have been issued and are in the enforcement / licensing / litigation stage. GA Court Upholds Employer’s Rights in Trotman v. Velociteach

A recent decision by the Georgia Court of Appeals addressed the issue of an employer’s rights when a former employee, upon leaving, uses the company’s proprietary materials to establish a new competing business.

In the case of Trotman v. Velociteach Project Management LLC, the trial court awarded project management training company, Velociteach, $147,750 from former employee Floyd Trotman and his new company, CertiFi, based on breach of contract, fraud, tortious interference with a business relationship, conversion, and misappropriation of trade secrets.
